These terms apply to nevarda.com and to everything you buy from us. By browsing the site or placing an order, you agree to them. If you do not agree, please do not use the site.

Who we are

Nevarda designs and sells low impact fitness equipment for home use. We operate from Ontario, Canada and ship across Canada and the United States. You can reach us any time through our contact page, and we reply within one business day.

Using this site

To place an order you must be at least the age of majority where you live, or have the permission of a parent or guardian. You agree to give accurate information when you order, and to keep your account details secure if you create an account. You may not use the site to break the law, to interfere with how it works, or to copy it for a competing business.

Products, prices and descriptions

We try to describe and photograph our products accurately. Colours can look different from screen to screen, and product photography is illustrative rather than exact. All prices are shown in Canadian dollars unless the site tells you otherwise, and they can change at any time before you place an order.

Occasionally a price, description or availability may be listed incorrectly. Where that happens we may correct the error and cancel any affected order, even after it has been confirmed. If you have already paid, we will refund you in full.

Orders

Your order is an offer to buy. We accept it when we send you a confirmation email, and a contract is formed at that point. We may decline or cancel an order, for example where stock has run out, where we suspect fraud, or where an order looks like it was placed for resale. If we cancel, we refund you in full.

You can cancel your own order for a full refund at any time before it is dispatched. Contact us as soon as you can and we will stop it if it has not already left.

Payment

Payments are processed by Shopify and its payment providers. By submitting payment details you confirm you are authorised to use the payment method, and you authorise us to charge the full order amount including any applicable taxes. We do not store your card details.

Shipping and delivery

Shipping is free to every address we serve in Canada and the United States, with no minimum order. Delivery timings, tracking and delays are covered in our Shipping Policy, which forms part of these terms.

Returns and refunds

You have 30 days from delivery to return an item for a full refund, and returns are free in both directions. The full detail is in our Refund Policy, which also forms part of these terms.

Using our equipment safely

Our products are exercise equipment, not medical devices, and nothing on this site is medical advice. If you are pregnant, recovering from injury or surgery, managing a health condition, or you have not exercised in a while, speak to a qualified professional before starting any new routine.

Please inspect your equipment before every session and stop using it if you see nicks, cracks, thinning or any other wear. Resistance tubing is under tension when you use it and can snap if it is damaged, over stretched, or anchored to something that gives way. Keep tubing clear of your face and eyes, do not stretch it beyond a comfortable range, and keep the equipment away from children and pets when it is not in use. You use our products at your own risk.

Our content

The text, photography, design and branding on this site belong to Nevarda or to the people we license them from. You are welcome to browse and share links. You may not copy, republish or use our content commercially without our written permission.

Reviews and anything you submit

If you send us a review, photo, comment or suggestion, you give us permission to use it to promote our products, with attribution to the name you supplied. Please only submit content that is yours to share and that is honest.

Other sites we link to

Where we link to another company's site or service, we are not responsible for its content, its products or its privacy practices. Review their terms before using them.

Warranties and liability

We provide the site and our products as they are. To the extent the law allows, we exclude implied warranties, and our total liability to you for any claim is limited to the amount you paid for the order the claim relates to. We are not liable for indirect or consequential loss, including injury arising from misuse of our equipment or from ignoring the safety guidance above.

Nothing in these terms limits any right you have under consumer law that cannot be limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Changes to these terms

We may update these terms as the business changes. The version published here at the time you order is the one that applies to your order, so it is worth reading them again before you buy.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled in the courts of Ontario, unless the consumer law where you live gives you the right to bring a claim closer to home.
